Terms of Service
These Terms of Service ("Terms") govern your use of the Hootz AI mobile application and related services (the "Service") provided by Anywhere Studio ("Hootz AI", "we", "us", or "our"). By downloading or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least the age of majority in your jurisdiction, or have the consent of a parent or legal guardian, and be old enough under your local law to use the Service. By using the Service you represent that you meet these requirements.
2. The Service
Hootz AI lets you create AI-generated videos and images from text prompts and from photos you upload, including prank, template-based, and freestyle creations. Each generation returns a single result. Features, models, and pricing may change, and we may add, modify, or remove functionality at any time.
3. Credits, subscriptions, and billing
- Generating content consumes credits. Credits may be granted through a subscription or purchased as consumable packages.
- Purchases and subscriptions are sold and billed by Apple through the App Store under Apple's terms. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period.
- You can manage or cancel a subscription in your Apple ID account settings. Deleting the app does not cancel a subscription.
- Except where required by law or by Apple's policies, purchases and consumed credits are non-refundable. Refund requests are handled by Apple.
4. Your content
You retain ownership of the photos and prompts you provide ("Input"). You represent that you have the rights to your Input and that it does not violate any law or third-party right. You grant us a limited license to process your Input and to operate, provide, and improve the Service, including sending Input to third-party AI providers to perform generation.
5. Acceptable use
You agree not to use the Service to create, upload, or share content that:
- Is unlawful, harassing, hateful, defamatory, or threatening.
- Uses another person's face, likeness, voice, or identity without their consent, or impersonates someone in a deceptive or harmful way.
- Is sexually explicit, depicts minors inappropriately, or sexualizes real people without consent.
- Promotes fraud, scams, violence, self-harm, or illegal activity.
- Infringes intellectual property, privacy, or publicity rights.
Pranks should be fun and good-natured. You are responsible for the content you create and for obtaining any consent needed before sharing videos that feature other people.
6. AI-generated content
Output is generated by automated models and may be inaccurate, unrealistic, or unexpected. Output may resemble content created by others, since similar prompts can produce similar results. You are responsible for reviewing Output before you use or share it, and for complying with the rules of any platform where you post it.
7. Intellectual property
The Service, including its software, design, and branding, is owned by Anywhere Studio and its licensors and is protected by law. Except for the rights expressly granted to you, we reserve all rights in the Service. Subject to these Terms, you may use the Output you generate for your personal and lawful purposes.
8. Third-party services
The Service relies on third-party providers, including Apple and AI and cloud vendors. Your use of those services may be subject to their own terms, and we are not responsible for them.
9. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that Output will meet your expectations.
10. Limitation of liability
To the maximum extent permitted by law, Anywhere Studio will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the twelve months before the claim.
11. Termination
You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or use the Service in a way that may cause harm or legal liability.
12. Governing law
These Terms are governed by the laws of Vietnam, without regard to its conflict-of-laws rules. Disputes will be resolved in the courts located in Vietnam, unless your local law requires otherwise.
13. Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above and, where appropriate, provide additional notice within the app. Continued use of the Service after changes take effect means you accept the updated Terms.
